Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and YelloGem (“YelloGem”, “we”, “us”) governing your use of the Axxess mobile application and related services (the “Service”). By creating an account or using Axxess, you accept these Terms. If you do not agree, do not use the Service. Contact: yellogem.ma@gmail.com.

1. The Service

Axxess lets you buy event tickets, store them in a personal wallet, present them for entry, and take part in the Axxess membership programme. Axxess provides the ticketing infrastructure; events themselves are produced and operated by independent organizers and venues (“Organizers”).

The Axxess programme grants tier status and perks based on your activity. Tiers, thresholds, and perks may change, and the programme may be modified or discontinued. Membership has no cash value.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in fraud or abuse.

6. Intellectual property

The Axxess app, brand, and content are owned by YelloGem or its licensors. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose. You retain rights to the limited content you provide (e.g. your display name).

7. Service availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may change, suspend, or discontinue features.

8. Disclaimers

The Service is provided “as is” and “as available” to the maximum extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not responsible for the acts or omissions of Organizers or for events themselves (including cancellation, quality, or safety).

9. Limitation of liability

To the maximum extent permitted by law, YelloGem will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid to us for the ticket(s) giving rise to the claim, or MAD 500.

You agree to indemnify YelloGem against claims arising from your misuse of the Service or violation of these Terms.

11. Changes to these Terms

We may update these Terms. We’ll update the “Last updated” date and, for material changes, give notice. Continued use means you accept the changes.

12. Governing law

These Terms are governed by the laws of the Kingdom of Morocco, and disputes are subject to the competent courts of Morocco, without prejudice to any mandatory consumer-protection rights you have where you live.

14. Apple App Store — Licensed Application terms

Because you obtained Axxess through the Apple App Store, the following apply (Apple’s minimum required terms) and prevail over the above only as to the Apple-provided app:

  1. Acknowledgement. This agreement is between you and YelloGem only, not Apple. YelloGem, not Apple, is solely responsible for the app and its content.
  2. Scope of license. The license is a non-transferable license to use the app on any Apple-branded products you own or control, as permitted by the App Store Usage Rules.
  3. Maintenance and support. YelloGem is solely responsible for support; Apple has no obligation to provide it.
  4. Warranty. YelloGem is solely responsible for any warranties. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); otherwise, to the maximum extent permitted by law, Apple has no warranty obligation.
  5. Product claims. YelloGem, not Apple, is responsible for claims relating to the app (including product-liability, legal/regulatory, and consumer-protection claims).
  6. Intellectual property. If a third party claims the app infringes its IP rights, YelloGem, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
  7. Legal compliance. You represent that you are not in a U.S.-embargoed country or on a prohibited/restricted-parties list.
  8. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
